The Commission monitors the following regulated industries:

• Telecommunications;
• Civil Aviations;
• Broadcasting;
• Postal; and |
• Electricity;
• Water & Sewerage;
• Ports;
• Other industries declared under Section 4 of the Commerce Act,1998. |
An example of an Access Agreement is sea pilot services. Large ships that enter Fiji ports require Fiji Ports Corporation Limited to supply them with experienced sea pilots to pilot their ships into the Fijian harbor. The shipping company pays a sum to FPCL for this specialized service. Seapilots Fiji, a company made up of experienced sea pilots decided to enter the piloting market. Since FPCL holds the monopoly and the industry is regulated, FPCL must sign an agreement with Seapilots and this must be filed with the Commission.
It is important to have statutory rights to access because:
- Owners of a monopoly or near monopoly bottleneck facilities and are in a position to are in a position to charge exorbitant prices for their services;
- It allows competitors to infrastructure facilities, which improves the quality of services provided as well as better prices; and
- It allows anyone in a position to supply the goods or services, to do so.
